Singapore Law Watch - Taxing times for CFOs


A COMPANY'S ability to effectively manage its taxes across borders affects not just its bottom line these days, but also its reputation in the eyes of stakeholders and the wider public. A spate of high-profile cases has put the spotlight on the issue of tax avoidance by large corporations in recent months. Tech giant Apple found itself in hot water when a US Senate committee found in May that all of its foreign sales were channelled through an Irish entity that paid no taxes. This and other cases have led to certain groups expressing outrage over corporate behemoths getting away with not paying their fair share of taxes.



Indeed, "tax morality" is emerging as one of the most prominent areas being scrutinised by governments, the general public and the media, said Tay Hong Beng, head of tax at KPMG in Singapore.



"This is the essence of concerns keeping CFOs and finance heads awake at night. More than just paying the legal obligations surrounding tax, the issue is becoming increasingly about paying a fair share of tax," he said. An organisation's reputation can risk significant damage if there is a perception that it has been overly aggressive in minimising its tax liability.



"If not effectively managed, the cost of getting it wrong is more than the financial cost of additional taxes, interest and penalties - it also includes the cost of senior management to resolve the issues, the potential financial viability of an investment, and the reputation of the corporation," said Brendan Egan, head of tax at insurer AIG APAC Holdings Pte Ltd.



Add to that the thorny issue of transfer pricing and the complexity of compliance across multiple jurisdictions and the tax landscape has become a particularly tricky one for senior finance executives to navigate.



"Unfortunately, potential and unexpected tax audit adjustments, challenges to group transfer pricing policies and the growing application of anti-avoidance provisions in a number of tax jurisdictions have served to increase the angst," said Alan Ross, head of tax at PwC Singapore.



The problem is compounded in the Asia-Pacific by the fact that tax systems across the region are far from homogenous with more nuances than perhaps one would find in Europe, he added.



Transfer Pricing



One significant issue facing CFOs is the issue of transfer pricing, which refers to the method of attributing a corporation's profit or loss before tax across the different countries it operates in. Since countries impose different corporate tax rates, companies try to allocate more of their profit to low-tax jurisdictions, in order to minimise the overall taxes they have to pay. Many countries impose penalties on corporations if they consider that they are being deprived of taxable profit.



While a global consensus on transfer pricing rules has yet to be established, some countries such as China and India are in favour of a system that puts an additional premium on their country's share of a group's profits in exchange for access to their large consumer markets, said Mr Ross.



"More business-friendly locations such as Singapore and Hong Kong and jurisdictions such as Switzerland, Ireland and Luxembourg therefore have to think about defending their tax revenue base derived from corporates operating out of their country as challenges on intercompany transfer prices eventuate in other counterparty jurisdictions," he said.



Meanwhile, tax compliance issues are particularly troublesome for companies with operations across several countries. For instance, more and more jurisdictions impose significant penalties for late filing of returns, incorrect returns, and the lack of transfer pricing documentation or transfer pricing adjustments.



This is particularly problematic for small-and medium-sized enterprises which cannot afford the luxury of engaging tax experts in every country in which they seek to operate.



"This necessitates the use of systems and control procedures to monitor issues and adherence to deadlines and typically a system of alerts where those deadlines are not being met," said Mr Ross.



Similar to the issue of perceived tax avoidance, the failure to comply with tax regulations can, apart from incurring financial costs, also potentially damage an organisation's reputation.



Indirect taxes



CFOs also have to deal with a trend among many governments towards using indirect taxes to balance their budgets, experts said.



"Given the impact of the global financial crisis which started back in September 2008, the level of corporate profits was impacted, as were the tax collections from direct taxes. The focus started to turn to indirect taxes as the taxing authorities' need to meet fiscal budgets intensified," said Mr Egan.



For instance, Malaysia recently indicated that it would be pushing to introduce a goods and services tax (GST) in its upcoming Budget in October to help curb the country's fiscal deficit and debt burden. Meanwhile, Japan is planning to hike its consumption tax rate, a move aimed at improving the country's finances.



With indirect taxes such as GST and Value-Added Tax (VAT) present in more than 150 countries, the impact of such taxes on cross-border trades can be significant.



However, as such taxes are not as well measured or managed as direct taxes, they are sometimes poorly understood, warned Mr Ross.



"Within organisations there is often a lack of clarity on where the responsibility for indirect taxes lies, whether in operations or in finance. Another problem is the lack of a common framework in Asia to harmonise the rules," he said.



A failure to properly manage a company's indirect taxes can result in a significant tax bill plus penalties for the company, as well as reputational risk for the organisation. The emerging challenges on the tax front means that companies must change their mindsets towards tax risk management, and realise that failure to deal with the changes can result in damage to more than just the bottom line.



"Companies need to watch the development at the local and international level closely. It is also important to ensure that tax decisions are made taking into consideration the reputational risks and not merely based on whether the tax law in the various jurisdictions has been complied with," said Mr Tay of KPMG.

Across U.S., people rally for 'Justice for Trayvon'

ATLANTA (AP) ? Crowds chanted "Justice! Justice!" as they rallied in dozens of U.S. cities Saturday, urging authorities to change self-defense laws and press federal civil rights charges against a former neighborhood watch leader found not guilty in the shooting death of unarmed teen Trayvon Martin.

The Rev. Al Sharpton's National Action Network organized the "Justice for Trayvon" rallies and vigils outside federal buildings in at least 101 cities one week after a jury delivered the verdict for George Zimmerman in Martin's 2012 death in a gated central Florida community.

"No justice! No peace!" participants chanted. Some sang hymns, prayed and held hands. Many held signs ? in Los Angeles, one read, "This is Amerikkka: From Dred Scott to Emmett Till to Trayvon Martin, black people have no rights that white people are bound to respect."

The case has become a flashpoint in separate but converging national debates over self-defense, guns, and race relations. Zimmerman, who successfully claimed that he was protecting himself when he shot Martin, identifies himself as Hispanic. Martin was black.

In Atlanta, speakers noted that the rally took place in the shadows of federal buildings named for two figures who had vastly differing views on civil rights and racial equality: Richard B. Russell was a Georgia governor and U.S. senator elected in the Jim Crow South; the Rev. Martin Luther King Jr. is the face of African-Americans' civil rights movement.

"What's so frightening about a black man in a hood?" said the Rev. Raphael Warnock, who now occupies the pulpit at King's Ebenezer Baptist Church.

In New York, hundreds of people ? including Martin's mother, Sybrina Fulton, and music superstars Jay-Z and Beyonce ? gathered in the heat.

Fulton told the crowd she was determined to fight for changes needed to ensure that black youths are no longer viewed with suspicion because of their skin color.

"I promise you I'm going to work for your children as well," she told the crowd.

Earlier Saturday, at Sharpton's headquarters in Harlem, she implored people to understand that the tragedy involved more than Martin alone. "Today it was my son. Tomorrow it might be yours," she said.

In addition to pushing the Justice Department to investigate civil rights charges against Zimmerman, Sharpton told supporters In New York that he wants to see a rollback of stand-your-ground self-defense laws.

"We are trying to change laws so that this never, ever happens again," Sharpton said.

Such laws are on the books in more than 20 states, and they go beyond many older, traditional self-defense statutes. In general, stand-your-ground laws eliminate a person's duty to retreat, if possible, in the face of a serious physical threat.

Zimmerman didn't invoke stand-your-ground, relying instead on a traditional self-defense argument, but the judge included a provision of the law in the jurors' instructions, allowing them to consider it as a legitimate defense.

Neither was race discussed in front of the jury. But the two topics have dominated public discourse about the case, and came up throughout Saturday's rallies.

"It's personal," said Cincinnati resident Chris Donegan, whose 11-year-old son wore a hoodie to the rally, as Martin did the night he died. "Anybody who is black with kids, Trayvon Martin became our son."

In Indianapolis, the Rev. Jeffrey Johnson told roughly 200 attendees that the rallies were about making life safer for young black men who are still endangered by racial profiling.

Johnson compared Zimmerman's acquittal to that of four white officers in the beating of black motorist Rodney King in 1992.

"The verdict freed George Zimmerman, but it condemned America more," said Johnson, pastor of the Eastern Star Church in Indianapolis and a member of the board of directors of the National Action Network.

In Miami, Tracy Martin spoke about his son.

"This could be any one of our children," he said. "Our mission now is to make sure that this doesn't happen to your child."

He recalled a promise he made to his son as he lay in his casket. "I will continue to fight for Trayvon until the day I die," he said.

Shantescia Hill held a sign in Miami that read: "Every person deserves a safe walk home." The 31-year-old mother, who is black, said, "I'm here because our children can't even walk on the streets without fearing for their lives."

Attorney General Eric Holder announced this week that his department would investigate whether Zimmerman could be charged under federal civil rights laws. Such a case would require evidence that Zimmerman harbored racial animosity against Martin.

Most legal experts say that would be a difficult charge to prove. Zimmerman's lawyers have said their client wasn't driven by race, but by a desire to protect his neighborhood.

Badgers football: Appleton native Chris Gill takes 'crazy path' to Madison

Having grown up in Appleton as a huge fan of the University of Wisconsin football team, Chris Gill is keenly aware of the story behind Mark Tauscher?s senior year with the Badgers.

In fact, Tauscher is a family friend of Gill and his four older brothers.

Tauscher was set to transfer to Youngstown State in Ohio for his final year of eligibility, wanting to become a teacher.

Jim Hueber, who was the UW offensive line coach at the time, didn?t even know Tauscher had a year of eligibility remaining before running into him at the Kentucky Derby and convincing him to finish his career with the Badgers.

Tauscher became the starting right tackle during the 1999 Rose Bowl season before going on to a successful NFL career as a starter with the Green Bay Packers.

Now, along comes Gill, who spent the past four seasons at Mississippi, including a redshirt year in 2009, prior to graduating.

After a casual conversation between one of Gill?s brothers and a member of the UW athletic communication department, Gill has transferred to UW, where he will be a walk-on center and eligible to play his final year in 2013.

He was accepted into a masters program for Educational Leadership and Policy Analysis on Tuesday and joined his new teammates for summer workouts on Thursday.

?It?s been kind of a crazy path to get here, but I?m so thankful I?ve got this opportunity,? Gill said ?Friday.

The 23-year-old Gill, 6-foot-4, 295 pounds, appeared in two games at Ole Miss, both coming last season. ?

The Badgers have an alarming lack of depth on the offensive line and Gill is capable of playing center, guard or tackle. He will start out at center behind redshirt freshman Dan Voltz, the projected starter.

?Wherever they need me, I?m more than happy to play,? Gill said.

Nobody is expecting Gill to become another Tauscher, but the stories have much in common.

?(Tauscher) is an unbelievable guy and an unbelievable player,? Gill said. ?I would never want to parallel myself to someone of his caliber. I really do hope the season is a lot of fun and I?m sure we?ll do great as a team.?

Gill?s path to UW started with a conversation between Ben, an older brother, and Patrick Herb, the main media contact for UW men?s basketball. Herb grew up in Appleton and was a roommate in college with Ben.

Chris planned to go to law school in Florida?.

?I was already enrolled and about to go, but I?ve been missing football a whole lot,? Chris said.

Greg Sr. and Cathie Gill have five boys ? and the first four all earned varsity letters at UW.

In order from the oldest: Greg Jr. was an All-American decathlete; Patrick was a linebacker who played for Barry Alvarez and earned a letter during the 1998 Rose Bowl season; Ben was All-Big Ten honorable mention in the decathlon; and Barry was a middle distance runner who earned All-Big Ten honorable mention as part of a relay.

Chris desperately wanted to play for the Badgers, but was undersized at 240 pounds after graduating from Appleton Xavier and didn?t get an offer.

?It was a little disappointing,? Chris said. ?I would have loved to play for the home state, it?s always been a dream.?

Among his offers were Colorado State, as well as the Naval and Air Force academies, but he elected to go to Hargrave Military Academy in Chatham, Va., for three months to increase his exposure.

The Southeastern Conference recruits that school heavily and Chris signed with Ole Miss, where his dad went to law school.

?He really liked playing for Houston Nutt,? Greg Sr. said. ?We?ve got nothing but great things to say about him.?

Chris played under offensive line coach Mike Markuson for three seasons. Markuson was hired as UW?s offensive line coach last season but fired after the second game. Two torn meniscus cartilage injuries stalled Chris? development early in his career, though he was healthy last season.

Nutt was fired after the 2011 season and replaced by Hugh Freeze, who decided to go with younger players on the line. If that had not happened, Chris probably would have played his final year at Ole Miss, his dad said.

Herb contacted UW cornerbacks coach Ben Strickland, who recruits in the state, after the conversation with Ben. Given UW?s need at the position, it seemed like a perfect marriage between Chris and the Badgers.

?I told him, ?You can go to law school any time you want, you can?t (play football) again,? ? Greg Sr. said. ?They?re glad to have an experienced, mature young man. Chris is a great student. Houston Nutt kind of summed it up when he said he was the most coachable kid he ever had. I think (UW coaches) are looking for some maturity, dependability, someone who?s not going to get rattled.?

?Nobody knows if this story will end as well as Tauscher?s did, but given the Gill family?s ties to UW, it?s already a good tale. The entire family is already making plans to attend as many games as possible.

?It?s a lot less expensive to drive to Madison to have beers and brats than fly to Oxford (Miss.) and get a condo for the week and drink wine and (eat) cheese,? Greg Sr. said.

Mass. police officer releases photos of 'evil' Boston bombing suspect

A Massachusetts State Police officer released photos of Boston Marathon bombing suspect Dzhokhar Tsarnaev that depicted him bloodied and lit up by sniper rifle sights in the aftermath of a massive manhunt, saying he wanted to show "the real Boston bomber.?

The release of the photos came amid uproar about a Rolling Stone magazine cover story image that some said glamorized the accused killer.

Tactical photographer Sgt. Sean Murphy said the hundreds of images of the manhunt for Tsarnaev in April that he gave to Boston Magazine show someone not ?fluffed and buffed for the cover of Rolling Stone magazine.?

The photographs released to Boston Magazine by Murphy show some of the hundreds of heavily armed police officers who scoured Watertown, Mass., in the search for Tsarnaev after his older brother Tamerlan was killed in a shootout with police. In some of the more than one dozen photographs published by the magazine, law enforcement officers dressed in camouflage gear and helmets surround the white boat in a backyard where Tsarnaev was ultimately found injured but alive.

In other photographs, the bleeding accused bomber slumps out of the tarp-covered boat with a laser beam from an officer?s sniper rifle trained on his forehead.

Murphy said in a statement to Boston Magazine that he released the photographs after being outraged by a photo of Tsarnaev printed to accompany a Rolling Stone cover story earlier this week, calling the image ?an insult.?

?An image like this on the cover of Rolling Stone, we see it instantly as being wrong,? Murphy said in the statement published on Boston Magazine?s website. ?What Rolling Stone did was wrong. This guy is evil. This is the real Boston bomber. Not someone fluffed and buffed for the cover of Rolling Stone magazine.?

Three people were killed, including an 8-year-old boy, and more than 200 injured when blasts from two homemade bombs rocked the finish line of the Boston marathon on April 15. Tsarnaev appeared for an eight-minute hearing in federal court on July 11, where he pleaded not guilty to a 30-count indictment.

The court appearance was attended by scores of bombing survivors and their families. More than a dozen officers from the Massachusetts Institute of Technology police force stood outside the courthouse in apparent homage to Officer Sean Collier, who died in a shooting in the course of the manhunt.

Family members of the survivors said the defendant appeared to smirk and appear indifferent to the court proceedings, speaking only to enter his plea with an accent reflecting his Chechen background.

The editor-in-chief of Boston Magazine wrote in a post later on the publication?s website on Thursday that Murphy had been relieved of duty, but not fired. His status of duty was to reviewed next week, editor John Wolfson wrote.

Murphy, who described himself as a 25-year veteran of law enforcement, was relieved of his gun, badge, cameras, and police identification, according to Wolfson?s post. He was also reportedly ordered not to have any further communication with the press.

NBC News was not able to immediately verify the report, and calls for comment to the Massachusetts State Police were not returned. In a statement, a spokesman for the state police said that the release of the photos was not authorized.

?Today?s dissemination to Boston Magazine of photographs of Boston Marathon bombing suspect Dzhokhar Tsarnaev and police activity related to his capture was not authorized by the Massachusetts State Police,? spokesman David Procopio said in a statement Thursday night, according to the Boston Globe. ?The department will not release the photographs to media outlets.?

A spokeswoman for U.S. Attorney Carmen M. Ortiz called the release of the photos ?completely unacceptable,? according to the Boston Herald.

?We have spoken with the Massachusetts State Police, who have assured us that the release of the photos was unauthorized and that they are taking action internally in response,? the spokeswoman said.

The editors of Rolling Stone have defended the cover photo of Tsarnaev, which was headlined ?The Bomber? and included a tagline that called the man ?a monster.? Stores including CVS and Tadeschi Foods have announced that they will not sell the issue on their newsstands.

?Our hearts go out to the victims of the Boston Marathon bombing, and our thoughts are always with them and their families,? Rolling Stones? editors said in a statement. ?The fact that Dzhokhar Tsarnaev is young, and in the same age group as many of our readers, makes it all the more important for us to examine the complexities of this issue and gain a more complete understanding of how a tragedy like this happens.?

But for many in Boston, Murphy said in his statement after releasing the photographs, the wounds from the 19-year-old Tsarnaev?s alleged actions are still raw.

?These were real people, with real lives, with real families,? Murphy said. ?I know from first-hand conversations that this Rolling Stone cover has kept many of them up ? again.? It?s irritated wounds that will never heal ? again. There is nothing glamorous in bringing more pain to a grieving family.?

Weight Loss May Help Thwart Diabetes - Health News and Views ...

FRIDAY, July 19 (HealthDay News) ? Overweight people with pre-diabetes can reduce their risk of developing type 2 diabetes by losing a significant amount of weight, according to new research.

The study found that those who lost 10 percent or more of their body weight had an 85 percent lower risk of developing diabetes within three years, while those who lost 5 percent to 7 percent of their body weight had a 54 percent lower risk.

The findings offer patients and doctors a guide to how short-term behavior change may affect long-term health, the researchers said.

?We have known for some time that the greater the weight loss, the lower your risk of diabetes,? study leader Dr. Nisa Maruthur, an assistant professor in the division of general internal medicine at the Johns Hopkins University School of Medicine, said in a Hopkins news release.

?Now we understand that we can see much of the benefit of losing that weight in those first six months when people are adjusting to a new way to eating and exercising,? Maruthur said. ?Substantial weight loss in the short term clearly should go a long way toward preventing diabetes.?

The study included more than 3,000 patients who were assigned either to be part of a lifestyle intervention group, or to take the diabetes drug metformin, or to take a placebo. Metformin is taken to lower blood sugar levels.

The patients all had pre-diabetes, which means their blood sugar levels were higher than normal but not yet high enough to be considered type 2 diabetes.

Those in the lifestyle intervention group were given advice about healthy eating, told to exercise 150 minutes a week, and given one-on-one counseling for the first six months and group counseling for the remainder of the three-year study.

While the patients who took metformin did not lose significant amounts of weight, their blood sugar levels were significantly lower after six months and they did have a lower risk of developing diabetes.

The lowest risk of diabetes was seen in patients who lost weight and also lowered their blood sugar levels, according to the study published online July 16 in the Journal of General Internal Medicine.

700 criminals deported in London crackdown to be copied by rest of country

Since the launch of Operation Nexus last September 700 rapists, burglars, thieves, fraudsters, gang members and other offenders have been removed.

The joint initiative between the Home Office and the Metropolitan police has proved so successful that ministers now want to roll it out across the country. A Home Office spokesman said: ?By combining expertise and intelligence with the Met, we are speeding up the removal process and using the full force of immigration powers on those who seek to abuse the system, commit crime, and damage our communities.?

Operation Nexus was set up after intelligence showed that 28 per cent of all those arrested for a criminal offence in London were foreign nationals.

It involves a 100-strong squad which targets foreign nationals either committing, or suspected of committing crime in the capital.

Meanwhile, teams of immigration officials have been posted to 21 custody suites in London, allowing them to run checks more easily on suspects who have been brought in. The spokesman added: ?Foreign nationals who break our laws should be removed at the earliest opportunity and Operation Nexus is already proving a success with more than 700 foreign national offenders, including high-harm gang members, being removed from the UK to date.?

Successes so far include the deportation of a 36-year-old Jamaican man from Lewisham who was charged with a series of sexual offences, including the 2011 gunpoint rape of a vulnerable woman, but never convicted.

The man with a history of domestic violence was forcibly removed from the UK using immigration legislation and is prohibited from returning for at least 10 years.

Meanwhile a 21-year-old Ghanaian national was removed after he was identified as a prominent member of a gang in Croydon. In another case a 21-year-old Albanian was removed the day after his arrest for affray.

The Home Office operation has also seen partnerships established with forces from countries where high volumes of offenders are identified.

Twenty officers have been seconded to the UK from Romania.

Japan Airlines Dreamliner safely returns to Boston

BOSTON (AP) ? A Japan Airlines flight to Tokyo's Narita Airport has returned safely to Boston's Logan Airport because of a possible fuel pump issue on the Boeing 787 aircraft.

It's the latest woe for the new Dreamliner aircraft after a lithium ion battery problem grounded the fleet in January and a fire on an Ethiopian Airlines plane last week.

Japan Airlines spokeswoman Carol Anderson says Flight 007 returned Thursday as a precautionary measure to check out a maintenance message indicator showing the possible fuel pump problem.

Federal Aviation Administration spokeswoman Arlene Salac says the pilot didn't declare an emergency and the aircraft burned off fuel before landing.

The plane left for Tokyo about 1 p.m. Thursday for a 14-hour flight. It returned about 6 p.m.

Boeing Co. is based in Chicago. The 787 is assembled in Washington and South Carolina.

Photog releases photos of Boston bombing suspect

(AP) ? A police photographer, furious with a Rolling Stone cover photo he believes glamorizes the surviving Boston Marathon suspect, released gritty images Thursday from the day he was captured.

Photos released to Boston Magazine by Massachusetts State Police tactical photographer Sgt. Sean Murphy show a downcast, disheveled Dzhokhar Tsarnaev with the red dot of a sniper's rifle laser sight boring into his forehead.

The pictures were taken when Tsarnaev was captured April 19, bleeding and hiding in a dry-docked boat in a Watertown backyard.

Murphy said in a statement to Boston Magazine that Tsarnaev is evil and that his photos show the "real Boston bomber, not someone fluffed and buffed for the cover of Rolling Stone magazine."

The April 15 bombing killed three people and injured more than 260. Massachusetts Institute of Technology officer Sean Collier was allegedly killed April 18 by Tsarnaev and his brother, Tamerlan, who died following a shootout with police later that evening.

State police spokesman David Procopio said in a statement Thursday that the agency did not authorize the release of the photos to Boston Magazine and will not release them to other media.

Boston Magazine editor John Wolfson, who wrote the story accompanied by Murphy's photos, later tweeted and reported on the magazine website that Murphy was "relieved of duty" and had a hearing next week. Asked by The Associated Press about Murphy's job status, Procopio said in an email that the state police will conduct an internal investigation into Murphy's release of the photos.

Murphy, who did not return a message from the AP, said in his statement to Boston Magazine that Rolling Stone's cover photo, a softly-lit image of a brooding Tsarnaev, insults officers killed in the line of duty, their colleagues and their families by glamorizing the "face of terror."

"It also could be an incentive to those who may be unstable to do something to get their face on the cover of Rolling Stone magazine," he said.

Rolling Stone said the cover story on Tsarnaev was part of its "long-standing commitment to serious and thoughtful coverage of the most important political and cultural issues of our day."

Boston Magazine printed more than a dozen photos from the day Tsarnaev was captured, including images of police during the manhunt and Tsarnaev as he was captured and taken away by ambulance.

Three images showed Tsarnaev as he emerged from the boat, head bowed, with red smudges and streaks on his clothing and the boat.

Two images showed the red dot of the laser sight in the middle of his forehead and just above his left eye. The other showed the dot on the top of his head as he buries his face in his arms.

In his statement, Murphy said the capture played out like a television show, but he hopes his photos show it was "as real as it gets."

"Officer Sean Collier did give his life. These were real people, with real lives, with real families," he said. "And to have this cover dropped into Boston was hurtful to their memories and their families.

"I know from first-hand conversations that this Rolling Stone cover has kept many of them up ? again. It's irritated the wounds that will never heal ? again," he wrote. "There is nothing glamorous in bringing more pain to a grieving family."

Senators ready to restore lower college loan rates

WASHINGTON (AP) ? Senators are ready to offer students a better deal on their college loans this fall, but future classes could see higher interest rates.

The Senate could vote as early as Thursday on a bipartisan compromise that heads off a costly increase for returning students.

"We should get it done as quickly as possible. We can do it today," Senate Majority Leader Harry Reid said Thursday.

The compromise could be a good deal for students through the 2015 academic year, but then interest rates are expected to climb above where they were when students left campus in the spring.

Under the deal, all undergraduates this fall could borrow at 3.85 percent interest rates. Graduate students would have access to loans at 5.4 percent, and parents would be able to borrow at 6.4 percent. Those rates would climb as the economy improves and it becomes more expensive for the government to borrow money.

The deal was described by Republican and Democratic aides who insisted on anonymity because they were not allowed to be publicly identified discussing the ongoing negotiations.

Undergraduates last year borrowed at 3.4 percent or 6.8 percent, depending on their financial need. Graduate students had access to federal loans at 6.8 percent and parents borrowed at 7.9 percent.

The interest rates would be linked to financial markets, but Democrats won a protection for students that rates would never climb higher than 8.25 percent for undergraduates. Graduate students would not pay rates higher than 9.5 percent, and parents' rates would top out at 10.5 percent.

The bipartisan agreement is expected to be the final in a string of efforts that have emerged from near-constant work to undo a rate hike that took hold for subsidized Stafford loans on July 1. Rates for new subsidized Stafford loans doubled from 3.4 percent to 6.8 percent, adding roughly $2,600 to students' education costs.

Lawmakers from both parties called the increase senseless but differed on how they thought the lower rates should be restored.

Democrats had urged a one- or two-year extension of the current rates, while lawmakers plan to do a complete rewrite of the Higher Education Act in the fall to address the larger issue of college costs. Reid said he would allow members of his caucus one more attempt at the tactic but urged his colleagues to back the long-term proposal.

Republicans have pushed for a link between interest rates and the financial markets. Obama included that link in his budget proposal, as did House Republicans. Democrats balked, saying it could produce government profits on the backs of borrowers if rates continued to climb.

Leaders from both parties, however, recognized the potential to be blamed for the added costs in the 2014 elections if nothing were done.

Senate aides said a vote on the agreement could come as early as Thursday, although it could be pushed back to the middle of next week.

The House has already passed student loan legislation that also links interest rates to the 10-year Treasury note. The differences between the Senate and House versions are expected to be resolved before students return to campus this fall, and Obama is expected to sign the bill.

Few students had borrowed for fall classes. Students typically do not take out loans until just before they return to campus, and lawmakers have until the August recess to restore the lower rates. The students who had borrowed for summer programs since July 1 would have their rates retroactively reduced.

The deal was estimated to reduce the deficit by $715 million over the next decade.

Lawmakers and their top aides have been tinkering with various proposals ? nudging here, trimming there ? trying to find a deal that avoids added red ink for students and the government alike.

Democrats and Republicans met with Obama and Vice President Joe Biden on Tuesday at the White House. An outline of an agreement seemed to be taking shape Tuesday, with follow-up meetings Wednesday in Democratic Sen. Dick Durbin's office yielding a final agreement.

Democratic Sen. Joe Manchin of West Virginia and Republican Sen. Richard Burr of North Carolina were the main negotiators, with Republican Sen. Lamar Alexander of Tennessee and Durbin filling the role of mediators. Sen. Angus King, I-Maine, Sen. Tom Coburn, R-Okla., and Sen. Tom Carper, D-Del., also were pushing the compromise to colleagues.

A senior administration official said the White House, too, was involved in the negotiations and that the White House supported the agreement. The official was not authorized to discuss the negotiations on the record and spoke on condition of anonymity.

Recently I came across a book by Rebecca Yue, ?Chinese Calligraphy Made Easy?. Learning something from books can be difficult sometimes, especially if you have no idea what you are dealing with. There might be times where you get frustrated and this as well as not being able to ask an instructor can lead to giving up. With this book you can have a great start with Chinese Calligraphy without needing to consult an instructor.

The book is divided into six chapters, with each chapter including several lessons. In the introduction of the book, you can find a summary of the development of Chinese calligraphy over time. In the first chapter the author explains the materials needed for calligraphy. You can find detailed information about the calligraphy brushes and where to use them. Also, you will find information about types of paper and ink that you are going to need.You will continue to learn about the history of these materials as you read.

After the introduction of materials and before the basic techniques, the preparation phase and the methods to hold and use the brushes are explained in writing and with graphics and pictures as well. Once you are done with the important basics, you are ready to start having fun!

The great thing about this book is, as you learn the techniques or brushstrokes, you are able to apply what you learn right away. There are some easy art projects that you can create with what you just learned in the chapter. You can create traditional writing book, you can make greeting cards etc. You can make anything. Since I had the book, I followed the instructions in the book and I made bookmarks with different words on them and gave them to my friends as gifts. Arabs back Kerry push to renew Israel-Palestinian talks

AMMAN (Reuters) - The Arab League endorsed the drive to relaunch Palestinian-Israeli peace negotiations led by U.S. Secretary of State John Kerry, who said gaps between the sides had been greatly narrowed.

The encouraging rhetoric after Kerry met an Arab League delegation and Palestinian President Mahmoud Abbas in Jordan on Wednesday suggested that Kerry, on his sixth such peace mission to the Middle East in as many months, might have found a path to ending an almost three-year deadlock.

The main sticking point has been Israel's continued building of settlements on occupied land where Palestinians want to found a state. Israel approved new settlement on Wednesday.

Facing censure from Islamist Hamas rivals, the Western-backed Abbas has in the past looked for Arab League support before engaging in talks with the Jewish state. The 22-nation League also confirmed a recent compromise on its 11-year-old peace proposal to Israel; it said old borders could be redrawn.

The official Petra news agency in Jordan, where Kerry met Abbas for a second time in two days, quoted an Arab League statement issued after League officials also met Kerry there. The bloc affirmed "its support for Kerry's great efforts to revive peace talks between the Palestinian and Israeli sides".

The League delegation "expressed hope that this will lead to a launch of serious negotiations to address all final status issues to end the conflict and achieve a just and comprehensive peace between the Palestinians and Israelis which will bless the region with security, stability and prosperity".

Abbas has given no public indication of his intentions. Aides said he would meet other PLO (Palestine Liberation Organization) leaders in the West Bank city of Ramallah on Thursday ahead of deciding whether to resume talks with Israel.

The Palestinians were buoyed on Tuesday by EU plans to bar financial assistance to Israeli organizations operations in the occupied territories. Israel, which wants to keep swathes of West Bank settlements under any peace accord, was incensed.

Israeli Prime Minister Netanyahu's rightist government announced a new settlement expansion on Wednesday. An Israeli official said Netanyahu told Kerry that the EU move "hurt efforts to renew the diplomatic process".

GAPS NARROWED

But Kerry, briefing reporters in the Jordanian capital Amman, was upbeat.

"We have been able to narrow these gaps very significantly," he said. "And so we continue to get closer and I continue to remain hopeful that the sides can soon be able to come and sit at the same table."

He did not elaborate, citing a need for discretion.

A positive Palestinian decision, if one were to emerge on Thursday or soon thereafter, would be the first tangible sign of progress in Kerry's nearly six-month drive to revive the Israeli-Palestinian peace process, now largely overshadowed by upheaval in Egypt and civil war in Syria.

Abbas has in the past said settlement expansion must stop before talks with Israel can get under way. Netanyahu has called on him to return to negotiations unconditionally.

Israel granted initial approval on Wednesday for the construction of 732 new homes in Modiin Ilit, a West Bank settlement midway between Jerusalem and Tel Aviv.

At the news conference, Kerry held out the prospect of the rewards Israel could reap in a deal leading to the creation of a Palestinian state on land seized in the 1967 Middle East war.

He said Israel should consider carefully a 2002 Arab League peace initiative that it rejected in the past.

"Israel needs to look hard at this initiative, which promises Israel peace with 22 Arab nations and 35 Muslim nations - a total of 57 nations that are standing and waiting for the possibility of making peace with Israel," he said.

The plan, put forward by Saudi Arabia at an Arab League summit in 2002, offered full recognition of Israel if it gave up all land it had occupied since 1967 and agreed to a "just solution" for Palestinian refugees.

Softening the plan three months ago, a top Qatari official raised the possibility of land swaps in setting future Israeli-Palestinian borders. Tzipi Livni, the Israeli cabinet minister responsible for efforts to restart Palestinian talks, at the time called Qatar's move "good news that should be welcomed".

The League statement on Wednesday confirmed that shift, speaking of the Arab peace initiative as providing for "an independent Palestinian state on the lines of June 4, 1967 with a limited exchange of territory of the same value and size".

Palestinians have voiced readiness for possible territorial trades but want deliberations on a future state to be based on the pre-1967 war lines. Netanyahu has called those indefensible, leaving Israel vulnerable to attack.

He has not spoken about land swaps but has said not all settlements would remain in Israeli hands under a future accord.

One compromise mooted in the Israeli media has been a U.S. statement declaring the pre-1967 lines a foundation for peace talks, and Netanyahu voicing reservations but effectively accepting that position.

Israeli officials said they were unaware of any plans by Kerry to visit Israel on his latest trip, and some diplomats and Middle East analysts are skeptical that the Israelis and Palestinians will resume peace talks soon.

The core issues that need to be settled in the more than six-decade-old dispute include borders, the fate of Palestinian refugees, the future of Jewish settlements in the West Bank and the status of Jerusalem.

Most countries consider Israel's settlements on occupied land illegal, a view it disputes.

Microsoft wants US to let it speak more freely about NSA data sharing

In a new letter to the United States? top legal official, Microsoft is now asking for permission to allow it to reveal more information concerning precisely how and under what circumstances Redmond and other tech companies are sharing data with the National Security Agency (NSA) and other federal agencies.

Recent news suggests that Microsoft has a fairly cozy relationship with the spy agencies. Earlier this week, Bloomberg reported that Microsoft gives the NSA early access to information about discovered security flaws and other bugs before fixing them publicly. Last week, new leaks from Edward Snowden?s trove showed that Skype chats and voice calls can be tapped by the NSA.

As Microsoft?s general counsel Bradford L. Smith wrote (PDF) on Tuesday:

Since the initial leak of NSA documents, Microsoft has engaged constructively with the Department of Justice, the FBI, and other members of the Intelligence Community on the ground rules governing our ability to address these issues and the leaked documents publicly. We have appreciated the good faith in which the Government has dealt with us during this challenging period. But we?re not making adequate progress. When the Department and FBI denied our requests to share more information, we went to the Foreign Intelligence Surveillance Court (FISC) on June 19 to seek relief. Almost a month later, the Government is still considering its response to our motion.

Last week we requested official permission to publicly explain practices that are the subject of newly leaked documents that refer to Microsoft and have now been misinterpreted in news stories around the world. This request was rejected. While we understand that various government agencies are trying to reach a decision on these issues, this has been the response for weeks. In the meantime, the practical result of this indecision is continued refusals to allow us to share more information with the public.

As we reported earlier, the newly published Snowden leaks indicate that Skype calls are getting to intelligence agencies in a "very clear" manner. That doesn't necessarily mean Microsoft is helping the government, and its most recent transparency report?(PDF) says that no Skype content has been disclosed to any government. However, it remains possible that Microsoft may have received from the Foreign Intelligence Surveillance Court a sealed order mandating the company's cooperation and silence.?The report does note that last year, Microsoft "provided guidance to law enforcement" regarding Skype a total of 210 times.

Filibuster fight: Senators scrapping over nominees

WASHINGTON (AP) ? A showdown looming, Republicans and Democrats groped for a compromise behind closed doors Monday over confirming stalled White House appointees in a dispute that threatened what little bipartisan cooperation remains in the Senate.

All 100 senators were invited to the rare closed-door meeting in the Capitol's Old Senate Chamber, just down the hall from where they normally debate the issues of the day with the public and news media in attendance.

Majority Leader Harry Reid insisted in advance that Republicans permit yes-or-no confirmation votes on all seven of the nominees at issue. If they won't, he declared, Democrats will change the Senate's rules to strip them of their ability to delay.

There was no formal response from Republicans, although Reid and Senate Republican leader Mitch McConnell met privately during the day. Officials said several possible compromises had been floated in various meetings and conversations.

"Maybe there's a little bit of a thaw," said Sen. John Thune, R-S.D., as he entered the meeting. "The leaders are continuing to talk, the White house is involved in discussions with some of our members. Nothing has resulted from that, but the fact that people are still talking is a positive."

Officials in both parties said there had been discussions about Republicans stepping aside to permit confirmation for nearly all of the seven, with Obama agreeing to submit a replacement for at least one of two stalled appointees to the National Labor Relations Board.

In a morning speech at the Center for American Progress, Reid said there was no room for a middle ground allowing votes on some but not all of the seven.

"Minor change, no big deal," he said then of the possible rules change. "My efforts are directed at saving the Senate from becoming obsolete."

Republicans counter that a rules change made unilaterally by one party would profoundly alter the Senate, where both parties pay tribute to maintaining minority rights that are far stronger than in the House. Rules changes generally are made with a two-thirds vote of the Senate, meaning they must be bipartisan.

"I guarantee you, it's a decision that, if they actually go through with it, they will live to regret," McConnell said last week of the Democrats.

At the core of the dispute is the minority party's power to stall or block a yes-or-no vote on nearly anything, from legislation to judicial appointments to relatively routine nominations for administration positions. While a majority vote is required to confirm presidential appointees, it takes 60 votes to end delaying tactics and proceed to a yes-or-no vote.

The Democrats are threatening to change the rules only as they apply to nominations for administration positions, not judges or legislation, although Reid appeared to hedge when asked what other changes he might want to make the Senate more effective. "Nothing right now," he said.

Sen. Jeff Flake, R-Ariz., noting he was elected to the Senate only last year, said that despite Reid's contention the change was potentially momentous. He said the need for confirmation means appointees must hear the concerns of individual senators in a way that is not the case with House members. He said the chances were strong that once the rules were altered, one party would expand the change to include "judicial nominees that have a lifetime tenure" or even legislation.

At the White House, spokesman Jay Carney said Obama believes "the Senate ought to function and hopes the Senate will figure out a way that the nomination process is appropriately streamlined."

For now, he noted, "We're talking here about executive branch nominees." But he quickly added, "We have big problems on the judicial branch nomination process too."

In its purest form, a Senate delay can mean a classic filibuster ? such as when Sen. Strom Thurmond stood at his desk in 1957 and spoke for a few minutes longer than 24 straight hours in an unsuccessful attempt to prevent action on historic civil rights legislation.

In the past half-century, the filibuster has evolved, as have other means of stalling votes without requiring an around-the-clock speech that defies human endurance.

In the current case of Gina McCarthy, who was named to head the Environmental Protection Agency in March, Reid said during the day that Republicans had submitted more than 1,100 questions for her to answer about her plans at an agency they frequently criticize. He said they also refused to attend a committee hearing to vote on the nomination, forcing Democrats to summon a mortally ill Democratic Sen. Frank Lautenberg, D-N.J from home so enough lawmakers would be present to conduct business.

Reid said he called Lautenberg's wife, and said, "We have to have him here. And he literally on his deathbed came down here, unhooked the stuff that is keeping him alive, came down here from New Jersey." Lautenberg has since passed away.

In recent days, Republicans have signaled they will no longer attempt to block votes on several of the seven, including McCarthy, Labor Secretary-designate Tom Perez and Fred Hochberg to head the Export-Import Bank. They have refused to agree to the same for Richard Cordray, named in 2011 to head a newly created Consumer Finance Protection Bureau, or Richard Griffin and Sharon Block, appointed the same year to the National Labor Relations Board. Also stalled is Mark Pearce, nominated this year to a new term as head of the NLRB, which rules on collective bargaining disputes between unions and employers.

Cordray, Griffin and Block are in their posts, after Obama bypassed the Senate and gave them recess appointments. But an appeals court has ruled the two NLRB appointments are invalid, raising the prospect that all of their actions to date could be voided, and the Supreme Court has agreed to hear an appeal.

Last week, McConnell urged the administration to name two replacements for Griffin and Block, whom he called tainted appointments, and pledged quick consideration. Time is particularly significant in connection with the NLRB, because Pearce's current term expires at the end of the month. That would leave only two of five board's positions filled, not enough for it to issue rulings.
