Financial Services Roundtable Joins Up With Homeowner Group to ...

It?s not often that the homeowner advocates at the Center for Responsible Lending and the bank lobbyists at the Financial Services Roundtable agree on anything. But they?re teaming up on urging Congress to extend the Mortgage Forgiveness Debt Relief Act, which would continue the foreclosure crisis-era policy of forgiving payment of taxes on debt forgiveness like a principal reduction or a short sale.

In letters to the Senate Finance Committee and the House Ways and Means Committee, which have jurisdiction over tax law, CRL and the FSR describe the debt relief law as ?critical to helping homeowners and communities struggling with the ongoing foreclosure crisis.? They also note that failing to extend the law would threaten a housing recovery.

As I?ve been writing, if Congress fails to extend the MFDRA, come January 1, every homeowner receiving debt relief on their mortgages, through either principal forgiveness or short sale, would see that forgiven debt count as earned income for tax purposes. Borrowers could plead tax insolvency to exempt themselves from the tax liability, but that?s a bruising process. The resulting tax liability would make borrowers extremely unlikely to accept the terms of any debt forgiveness, as it would cost them too much on the back end. Struggling homeowners don?t typically have $50,000 lying around to pay the federal government after getting a break on the principal balance on their home.

The Financial Services Roundtable, now under the direction of Tim Pawlenty, likes the law because it facilitates those short sales, which have been booming of late. Short sales are one of several housing policies that are actually beneficial for all sides. The homeowner doesn?t go through foreclosure and gets to sell their home without incurring a debt as they otherwise would; the bank gets a higher price for the home than it would if it fell into foreclosure, and a more streamlined process where they never have to take ownership. Principal reduction happens to be beneficial for all sides as well relative to foreclosure, but banks have resisted it because it represents a bigger loss for them. Still, failure to extend the MFDRA would have the effect of stalling out BOTH of these options.

As for the foreclosure fraud settlement in place that mandates debt forgiveness up to a certain level, this expiration would effectively cancel it. The borrower would owe so much in taxes, they would never assent to taking the debt relief.

The Senate Finance Committee passed a one-year extension as part of a larger ?tax extenders? bill, but despite bipartisan support, they have not been able to move that bill to the floor, and it has similarly gone nowhere in the House. And time is running out. Having the Financial Services Roundtable on board with what is a priority for homeowner advocates makes passage slightly more likely, but if you know anything about the 112th Congress, you wouldn?t use the word ?likely? about anything.

Director Kappos's Speech on Software Patents, the PTO, and ...

Last week, Director of the USPTO David Kappos delivered a keynote address to the Center for American Progress that focused on software patents and the smartphone "patent wars."? The speech is noteworthy for the Director's strong defense of software patents. The entire speech is worth reading - here are a few excerpts to induce you to read the full speech:

Software patents, like all patents, are a form of innovation currency. They are also ecosystem enablers, and job creators. The innovation protected by software patents is highly integrated with hardware. All of it must remain eligible for protection. The current software patent ?war? is hardly the first patent war?and unlikely to be the last in our nation?s patent history. Whenever breakthrough technologies come onto the scene, market players find themselves joined in the marketplace by new entrants. The first instinct of the breakthrough innovators is to bring patents into play. This is not only understandable, it is appropriate. Those who invest in breakthrough innovation have a right to expect others to respect their resultant IP. However, in the end, as history has shown time and time again, the players ultimately end up agreeing to pro-consumer solutions via licenses, cross-licenses or joint development agreements allowing core technologies to be shared.

So does that mean we?re done? End of speech? Should we just accept the problems, given the importance of the innovation and the illogic of discriminating against great technology that happens to be implemented in software? Of course not. The right point of inquiry is quality. By getting that right, we grant patents only for great algorithmic ideas worthy of protection, and not for everything else. This administration and its innovation agency understand that low-quality patents do no good for anyone. Low quality patents lead to disputes, uncertainty, and lost opportunity. Quality is central to our mission. All of this especially for software.

So we?ve been working on the underlying drivers for software patent quality from the beginning. Knowing that you get what you measure, starting in the summer of 2009 we assembled a taskforce to devise a comprehensive new set of quality metrics. That work culminated in 2010, when we rolled out the most complete, broad, objective patent quality measurement system on the planet ? seven metrics, which we report eagerly to the public. The Lexus of quality metrics. And what do those metrics show? Patent quality isn?t broken at all. In fact, our decisions on both allowances and rejections correctly comply with all laws and regulations over 96 percent of the time.

You know, the history of software patents is not a perfect one, although things are improving. Some of the most troublesome patents have expired; others can be challenged with new post-grant proceedings; and newer patents are quantifiably clearer, and aligned with current legal standards. But it?s important to note that, during the so-called smartphone patent wars, innovation continues at breakneck pace. A system like ours, in which innovation is happening faster than consumers can keep up, cannot fairly be characterized as ?broken?. Nor can it be said that the U.S. is just a receiver of all this innovation. Most of the innovation is taking place right here. Broken? What?

The fact is, the explosion of innovation?and follow-on litigation?that we see across consumer electronics hardware and software is a direct reflection of how our patent system wires us for innovation. It's both natural and reasonable that in a fast-growing, competitive market, innovators would seek to protect their breakthroughs using our patent system.

(AP) ? Lewis Hamilton won the pole position for the season-ending Brazilian Grand Prix on Saturday, while Formula One leader Sebastian Vettel will start fourth and title challenger Fernando Alonso eighth.

Hamilton set a lap of 1 minute, 12.458 seconds with his McLaren at Interlagos, just .055 in front of teammate Jenson Button.

Vettel's Red Bull teammate Mark Webber will start third after a lap of 1:12.581, with Vettel behind him following a run of 1:12.760.

Ferrari's Felipe Massa was fifth after clocking 1:12.987, while teammate Alonso only managed a lap of 1:13.253, hurting his chances of overtaking Vettel for the championship.

Vettel needs to finish fourth or better on Sunday to become F1's youngest three-time champion at age 25. Alonso, also seeking his third title, needs at least a podium finish to have any chance of overcoming a 13-point deficit in the standings.

Vettel said a mistake at the end of the qualifying session cost him a chance to start closer to the front, but he didn't think the result was "a disaster."

"Maybe it's not the best position that we could've gotten, but still we can be quite happy" he said. "I think there are more people behind us than in front of us. If we were 24th, than that would be disappointing, but I'm happy with fourth and there's plenty of opportunities for tomorrow in terms of tactics."

Hamilton, who won the 2008 championship at Interlagos, will be driving his last race with McLaren before joining Mercedes next season. He is coming off a victory at the United States GP last week.

"I think we put ourselves in a really good position and we are just going to do the best that we can from here, working together as a team," Hamilton said.

McLaren has been strong all weekend and seems set to play a role at the title showdown between Vettel and Alonso. Hamilton led the practice times on Friday and Button did the same earlier on Saturday. Vettel was always close behind the McLarens, while Alonso was well behind the pace.

Drivers had faced very warm temperatures during practice but it dropped significantly for qualifying. It started raining about half an hour before the timed session but it stopped by the time the cars hit the track. The top teams waited several minutes to avoid the slippery conditions at the tricky 2.8-mile track in South America's biggest city.

Michael Schumacher, preparing for his final race before retiring for a second time, couldn't do much with his Mercedes and will start 14th.

Mexican Sergio Perez, taking over Hamilton's seat at McLaren, will start 13th with his Sauber.

Lotus driver Romain Grosjean didn't make it past the first qualifying session after running into the back of Pedro de la Rosa while trying to make a pass at the front straight. He got off the throttle to avoid running into the slower HRT but it was not enough, forcing him to return to the pits for a new front wing.

Vettel enters the deciding race in a comfortable position to win his third title. He has been dominant recently, finishing on the podium in the last six races and winning four of them.

A fourth-place finish will be enough on Sunday even if Alonso wins the race. And if the Ferrari driver is second, Vettel can clinch the title by crossing the line seventh or better. The German driver holds the tiebreaker because he has more wins than Alonso ? five to three.

Vettel has a chance to become the first driver to win three titles in a row since Schumacher won five straight from 2000-04. The only other driver to win at least three consecutive titles was Juan Manuel Fangio from 1954-57.

Alonso hasn't won a race since the German GP in July, but he finished on the podium in six of the final seven races, including the last four.

It will be the sixth time since 2005 that the F1 season will be decided at the Brazilian GP. Alonso won both of his titles at Interlagos in 2005 and '06.

Red Bull has won the last three races at the track, with Vettel second to teammate Webber last year.

Schumacher, F1's most successful driver, retired for the first time in 2006 after winning seven world titles. He returned in 2010 with Mercedes, but struggled and managed only one podium finish, at the European GP in July.

Shoppers buy earlier this holiday season

CHICAGO/SAN FRANCISCO (Reuters) - Online shopping has grown sharply so far this holiday shopping season after U.S. retailers pushed out a slew of mobile and Internet deals that lured consumers before Cyber Monday, traditionally the biggest day for e-commerce in America.

While it remains to be seen if the gains over Thanksgiving Day and Black Friday can be sustained, the latest estimates show shoppers scooping up early special offers via their smart phones and tablets, the way they used to hunt for bargains in brick-and-mortar stores.

Online sales increased 17.4 percent on Thanksgiving and 20.7 percent on Black Friday, compared with 2011, according to IBM Smarter Commerce, a unit of International Business Machines Corp that analyzes transactions from 500 U.S. retailers.

Black Friday, the day after Thanksgiving, had traditionally been the kickoff to the holiday season for stores. This year, retailers such as Wal-Mart Stores Inc. and Target Corp. made their biggest push ever with special offers during the holiday itself.

"The Thanksgiving creep revitalized the thrill for people," said Wendy Liebmann, chief executive of WSL Strategic Retail. "It got people excited to go out. But it pulled a lot of sales forward."

Visits to stores rose 3.5 percent on Friday, down from a 4.7 percent increase last year, ShopperTrak estimated.

Sales actually fell an estimated 1.8 percent, the company, which analyzes store traffic, said. But if Thursday sales were added in, ShopperTrak estimates that "Black Friday" sales would have been up a little less than 1 percent from a year earlier.

"It's not a superstar Black Friday, but it also wasn't an underperform Black Friday," said Ed Marcheselli, chief marketing officer of ShopperTrak.

ONLINE SHIFT

Cyber Monday, which follows the long holiday weekend, has been the biggest day for online shopping in recent years, as workers return to their office computers.

Now, armed with mobile devices, particularly Apple Inc's iPad and iPhone, shoppers are no longer waiting. They are also using the devices to track down the lowest prices.

The average order value on Black Friday declined by 4.7 percent to $181.22, and the average number of items per order dropped 12 percent to 5.6, according to IBM.

Client sales on Black Friday rose 23 percent from last year, while Thanksgiving sales rose 32 percent year over year, estimated Mercent, which helps merchants sell more on websites including Amazon.com, ebay.com and Google Inc's online shopping program.

"What we don't know is whether this is a zero-sum game or whether there is some benefit to retailers by broadening the holiday shopping window," Best said. "There is risk that real growth in retail for the entire holiday may be overestimated based on these early numbers."

E-commerce software firm ChannelAdvisor said clients' same-store sales on eBay's online marketplace rose 27 percent on Thanksgiving and 31 percent on Black Friday, compared with a year earlier.

Last year's year-over-year growth was about 15 percent for eBay, ChannelAdvisor said.

"The online players are definitely participating more on Thanksgiving and Black Friday, so Cyber Monday is being shared with other holidays now," said Scot Wingo, chief executive ChannelAdvisor.

EBay usually grows more slowly early in the holiday season and then ramps up later as retailers run out of hot products and shoppers turn to eBay sellers for those items.

Its strong start this year is driven partly by the company's success in attracting mobile shoppers through shopping apps on smart phones and tablets, Wingo said.

EBay said on Saturday that the volume of mobile transactions on its online marketplace jumped 153 percent on Black Friday, compared with a year earlier. PayPal, the payments division of eBay, saw Black Friday volume almost triple, year over year.

More broadly, purchases from mobile devices accounted for 16.3 percent of online sales on Black Friday, up from 9.8 percent in 2011 and 3.2 percent in 2010, according to IBM data. Apple Inc's iPads and iPhones led the charge, with owners using the devices to browse and buy on retailer websites.

SHOPPERS 'WANT TO SPEND'

Overall, the percentage of sales from online shopping is expected to rise. But while retailers bring in more revenue from online shopping, they may also face some higher costs in terms of shipping a larger number of packages to more shoppers.

Among tablets, iPads were the clear leader, generating 88.3 percent of traffic to retailers' sites on Friday, followed by Barnes & Noble Inc's Nook with 3.1 percent, Amazon.com Inc's Kindle with 2.4 percent and the Samsung Galaxy with 1.8 percent, IBM said.

At the mall, stores continued to use discounts to lure shoppers on Saturday, with Aeropostale Inc discounting items as much as 70 percent after a storewide 60 percent discount on Friday.

Rival American Eagle Outfitters Inc continued its two-day sale at 40 percent off, and Gap Inc's namesake chain was offering 60 percent discounts for the entire weekend.

"The discounts were reasonable but didn't take your breath away," said Liebmann. "Retailers are being cautious."

The Garden State Plaza Mall in Paramus, New Jersey, appeared to be crowded on Saturday, although much quieter than on Black Friday, clerks at several stores said.

Vanessa Crenshaw, a 45-year-old accountant shopping at JC Penney, said that if stores pulled back on discounts, she would go elsewhere.

"You can always find a deal, someone will have a deal," she said.
